Bombay HC allows pre-arrest bail
In a fresh state of affairs, the Bombay High Court on Tuesday allowed interim protection from arrest to actor Sahil Khan in connection with a defamation case.
Reportedly, the case, filed in June, alleges a premeditated cyber campaign against an individual owning a company specialising in holding exhibitions.
Mumbai Police had registered an FIR against Sahil Khan and six others under sections 500 (defamation), 506 (punishment for criminal intimidation), 504 (intentional insult), 34 (common intention) of the Indian Penal Code, and relevant sections of the IT Act.
The FIR stated a dispute in the midst of Khan and the company director regarding space allocation in an exhibition.
Khan and others were allegedly, engaged in uploading defamatory, derogatory, and obscene material on Instagram to tarnish the company’s reputation. The company director also reported threats and abuse.
Earlier this month, Dindoshi sessions court rejected Khan’s anticipatory bail plea, although others were granted pre-arrest bail. Following the rejection, Khan, as of now in Russia, approached the High Court for protection from arrest.
Amidst the proceedings,
Justice NJ Jamadar was informed by Chavan over Khan’s current location in Russia.
Chavan was directed by the court to file an affidavit specifying Khan’s return date to India. The anticipatory plea will be heard again on 14 December.
Meanwhile, Khan sought anticipatory bail through his lawyer Rajiv Chavan.
