RPF Chetan Singh accused in Jaipur Train killing gets Judicial Custody
A Mumbai Court after refusing further extension of police remand and the Government Railway Police for brain mapping, polygraph, and narco-analysis tests on RPF constable Chetan Singh who opened fire in the Jaipur Mumbai Express and killed 3 persons has sent him to Judicial Custody on Friday.
The Railway Protection Force (RPF) too moved an application before the court for questioning the accused for an internal enquiry into the incident.
However, the court called for the say of the investigation officer of the case and adjourned the matter to August 14.
The accused was was produced before a magistrate court in suburban Borivali at the end of his previous remand on Friday and the GRP sought three days custody for further investigation over the matter.
Earlier, the defence lawyers Surendra Landage, along with Amit Mishra and Jaywant Patil who appeared for Singh opposed GRP’s application saying that the narco test is a violation of the fundamental rights and cannot be conducted if the accused does not consent for it and moreover such tests cannot be done if one is old or physically and mentally weak.
As per the defence lawyers, the prosecution made an allegation in its complaint that on the day of the incident, the accused had told his senior, Assistant Sub-Inspector (ASI) Tikaram Meena, about his ill health.
Reportedly, the defence argued that the accused was mentally ill was under medication and it is for this very reason, the narco test is not possible.
The defence further argued that the accused Chetan Singh may slip into a coma or die due to a drug overdose.
It is further learnt that the police, produced a letter with Singh’s signature, saying that he had consented for the tests.
But, as per Singh’s lawyer, upon enquiry with Singh, he had not given any consent for any tests and that his signature was forcefully taken by the police. ”.
Singh further told the court that he was being tortured mentally, his lawyers added.
The court after hearing all the arguments refused its nod to the probe agency to conduct the tests.
The GRP added the Indian Penal Code section 153 A, relating to promoting enmity amidst different groups on grounds of religion, besides charges for murder and kidnapping.
The incident took place on July 31 on board the moving Jaipur-Mumbai Central Express near Palghar railway station in Maharashtra.
