Now in a fresh case, a couple
Pronit Prem Nath and his wife Amisha.who own a real estate firm were booked onTuesday for allegedly duping husband of actor Karishma Tanna, Varun Bangera, and television host Samir Kochhar to the tune of of Rs 1.03 crore under the pretext of selling them flats in Bandra.

Reportedly, Andheri police has filed an FIR under sections 409 (criminal breach of trust by a public servant or by a banker, merchant, or agent), 420 (cheating), and 120B (criminal conspiracy) of the IPC against the accused couple, Pronit Prem Nath and his wife Amisha.

Kochhar,the complainant in the case, along with his wife and Varun Bangera, a real estate businessman, were looking for a property to buy in December 2020.

In the midst of this time, Kochhar and Bangera got to know about Nath and his wife were planning to build a four-storey building in Pali Village in Bandra (West).

Kochhar, his wife, and Bangera visited the property site and Nath shared details of the project with them.

Kochhar decided to buy a unit \for Rs 1.95 crore, and Bangera decided to buy another for
Rs 90 lakh.

According to FIR, Kochhars paid Rs 58.55 lakh, while Bangera paid Rs 44.66 lakh to Nath and his wife Amisha, totalling to Rs 1.03 crore.

After Kochhar’s police complaint, Nath did not disclose anything related to bank loans on the said property.
However, later, Kochhars and Bangera learnt that Nath had taken a loan from a financial organisation, and the said property could be mortgaged to repay the loan.

When Kochhars and Bangera confronted Nath over this, he assured them that they need not worry and would get their flats as promised without any financial liability on them, police said.

In June 2022, Nath even informed the Kochhars and Bangera that in the next three months they would get their flats with clearances.Tnx

However, on June 23, 2023, Nath informed Kochhars and Bangera that he no longer wished to sell them the flats. He also told them that he would return their money, the police said.

Kochar in his statement to the police said that he realised that as the pandemic phase was over, conditions had improved, and real estate prices had also increased, the accused couple changed their plan of selling the flats. They used their money for repaying their loans, improving their conditions, and for self-gain.

Kochhars and Bangera approached the High Court but by then Nath had allegedly sold the said flats to a third party in February 2023.

Following this, Kochhars and Bangera then approached the police and filed a police complaint.

According to Kochhar’s lawyer, Prerak Chaudhary, Pronit Nath entered into an MOU for the sale of flats with his clients and entered into an MOU for the sale of the same flats with another person. His clients are ready to perform the contract, but the accused are wriggling out.

For this purpose, a case has also been filed before the Honble Bombay High Court in which injunctive reliefs have been granted to us and Pronit Nath has been restricted from creating any third-party rights.

Pronit unsuccessfully filed an appeal against the order, which was also disposed of by the chief justice’s court.
