and TV host Samir Kochhar to the tune of of Rs 1.03 crore under the pretext of selling them flats in Bandra, get interim relief by the Bombay High Court from arrest till February 15.
The complainants are actress Karishma Tanna, husband Varun Bangera, and television host Samir Kochhar.
Reportedly, a single-judge bench of Justice Sarang V Kotwal earlier this month passed an order in plea by Pronit Nath and his wife Amisha in connection with an FIR filed by Andheri police in November, 2023, for offences punishable under sections 409 (criminal breach of trust by a public servant or by a banker, merchant, or agent), 420 (cheating) and 120B (criminal conspiracy) of the IPC.
Kochhar, one of the the complainant in the case, along with his wife and Varun Bangera, a real estate businessman, were looking for a property to buy in December 2020. In the midst of this time, this time, Kochhar and Bangera came to known that plans were afoot to develop a four-storey building in Pali Village in Bandra (West).
Kochhar, his wife, and Bangera visited the property site and Nath shared details of the project with them.
Kochhar decided to buy a unit for Rs 1.95 crore, and Bangera decided to buy another for Rs 90 lakh.
As per the FIR, Kochhar paid Rs 58.55 lakh for purchase of a flat on the third floor, while Bangera paid Rs 44.66 lakh to Nath and his wife Amisha, totalling Rs 1.03 crore.
Meanwhile, it was the plan by advocate Ashwin Thool for the applicants submission that at the highest it was a civil dispute for breach of contact and as Kochhar has already filed a civil suit, there was no criminality attached to the couple.
Meanwhile, Advocate Prerak Choudhary, appearing for Kochhar, sought time to file an intervention application.
The court asked Thool to add Kochhar as party respondent in the matter.
The bench noted and posted to the considerstion to the submissions advanced on behalf of the applicants today, till the next date. The applicants can be protected by way of ad-interim relief that the bench noted and posted.
